General Terms and Conditions of Business and Purchase
These General Terms and Conditions of Business and Purchase establish the procedure for accessing, ordering, paying for, delivering, and filing complaints regarding products and services offered on the KLARA MARIĆ online store at the primary internet address https://klaramaric.live/. The aforementioned website is owned by Klara Marić, Jurja Dobrile 2A, 52352 Kanfanar.
All materials found on the online store are the intellectual property of Klara Marić d.o.o., owned by Klara Marić, and may be used exclusively with the express approval of the copyright holder, as well as the holder of trademark and/or design rights. Klara Marić d.o.o., owned by Klara Marić, enables the use of the services and content of the online store as regulated by these Terms of Use and Purchase.
Within the framework of the online store, Klara Marić d.o.o., owned by Klara Marić, acts in the capacity of the Seller, and the Buyer is any visitor who orders one or more products from the Seller via the online store or in any other manner.
The Terms of Use and Purchase constitute part of the distance contract, together with the specifications and prices of the purchased products, and the Buyer will be required to accept them, i.e., declare that they are familiar with and agree to them, before confirming the order. The Seller reserves the right to amend the conditions at any time, provided that the specified amendments take effect upon publication on the online store.
Once the Buyer confirms and completes the order, the contract is concluded, and the Seller will notify the Buyer via email that the contract has been concluded. For a contract to be validly concluded, the Buyer must have full legal capacity, meaning they must be an adult (of legal age). The Buyer bears responsibility for the accuracy and completeness of the user data entered during registration, login, and/or product ordering. For persons completely lacking legal capacity, the contract may only be concluded by their legal representatives, while persons with partial legal capacity may conclude a contract only with the consent of their legal representative.
Access to the online store may sometimes be unavailable due to construction, maintenance, or the introduction of new content, as well as in cases of unforeseen circumstances beyond the Seller's control, which the Seller will endeavor to resolve in the shortest possible timeframe.
Product and Service Characteristics
Products on the online store are presented through textual descriptions and photographs, and the information regarding them is compiled based on the Seller's database. Product photographs are illustrative in nature and may not always correspond in every detail to the products that are the subject of the order. The Seller specifically emphasizes that the visual identity of the product shown in the photograph may not correspond to the appearance of the product in reality (which includes, but is not limited to, the screen settings of the device with which the user accesses the online store, the user's perception of colors, the method of photographing the product, variations in printing, etc.). In the event of the aforementioned discrepancy between the product shown in the photograph and the delivered product, it shall not be considered a product defect.
Product data displayed on the online store is subject to computer errors, application and/or server malfunctions, other technical irregularities, typographical errors, etc. The Seller will endeavor to provide the most precise description and image of the product on the online store but assumes no responsibility for the complete accuracy of the specified data. In the event of obvious errors or inaccuracies regarding product data, the Seller reserves the right to unilaterally terminate the contract.
Only products indicated in the order as available and accessible can be the subject of an order. Due to a large number of orders being processed simultaneously, it may happen that the product availability information does not match the actual stock status in the warehouse. If the ordered product is not available in stock, the Seller will notify the Buyer that the product is currently unavailable, provide the timeframe within which the product can be obtained, and simultaneously offer the option to purchase an alternative product available for delivery.
Product Price
Prices on the online store are expressed in euros (EUR). The cost of VAT is included in the product price. Delivery costs are not included in the product price, as they are charged separately.
Before order confirmation, the product price with VAT and the delivery cost are displayed separately. The delivery cost depends on the quantity and weight of the ordered products and is shown as an aggregate. The final price is displayed at the end of the purchase so that the Buyer has an overview of the total price they are paying for the ordered products and services.
In the case of payment via internet banking and national payment orders, the costs of the payment transaction and/or interbank transactions are not included in the price.
Delivery Costs
Delivery costs are calculated for each individual order depending on the number and weight of the ordered products, their total price, and the location to which they are to be delivered. Total delivery costs are displayed during the ordering process.
Delivery Cost within the Republic of Croatia:
The delivery cost depends on the value of the order in accordance with the Delivery Conditions.
The delivery timeframe is 24–72 hours from the moment the payment is visible on the Seller's account, except in exceptional cases defined by the Delivery Conditions.
Payment Terms and Methods
Prices on the webshop apply exclusively to orders placed via the internet.
The currency is EURO.
Ordered goods can only be paid for by card payment or wire transfer (R1 invoice).
Orders and Deliveries within the Republic of Croatia:
You can pay for ordered goods with credit cards or via wire transfer (R-1, corporate company invoice).
R-1 PAYMENT / WIRE TRANSFER (COMPANIES)
After the order is placed, we will send you an offer via the email you specified during the ordering process within 24 hours. You pay for the ordered goods according to the offer within 24 hours, and upon receipt of the payment, the ordered goods will be sent to your address.
PAYMENT BY DEBIT AND CREDIT CARDS (VISA, MAESTRO, AND MASTERCARD)
When paying on our web store, you use CorvusPay – an advanced system for secure internet acceptance of payment cards. CorvusPay ensures the complete confidentiality of your card data from the moment you enter it into the CorvusPay payment form. Payment data is transmitted encrypted from your web browser to the bank that issued your card. Our store never comes into contact with the complete data of your payment card. Furthermore, the data is inaccessible even to the employees of the CorvusPay system. The isolated core independently transmits and manages sensitive data, keeping it completely secure in the process. The form for entering payment data is secured by an SSL transport encryption of the highest reliability. All stored data is additionally protected by encryption, using a cryptographic device certified according to the FIPS 140-2 Level 3 standard. CorvusPay meets all online payment security requirements prescribed by leading card brands, meaning it operates in compliance with the PCI DSS Level 1 standard – the highest security standard in the payment card industry. When paying with cards included in the 3-D Secure program, your bank additionally confirms your identity using a token or password, alongside verifying the validity of the card itself. Corvus Info considers all collected information to be a banking secret and treats it accordingly. The information is used exclusively for the purposes for which it is intended. Your sensitive data is completely secure, and its privacy is guaranteed by state-of-the-art protection mechanisms. Only the data necessary to perform the transaction is collected, in accordance with the prescribed demanding procedures for online payment. Security controls and operational procedures applied to our infrastructure ensure the ongoing reliability of the CorvusPay system. In addition, by maintaining strict access control, regular security monitoring, and in-depth checks to prevent network vulnerabilities, as well as the planned implementation of information security provisions, they permanently maintain and improve the security level of the system by protecting your card data.
Product Delivery
We deliver via the courier services GLS and Hrvatska pošta.
The delivery timeframe is 24–72 hours from the moment the payment is visible on the Seller's account for delivery within the territory of the Republic of Croatia, except in exceptional cases defined by the Delivery Conditions.
If an impossibility to deliver the selected product arises due to temporary or permanent unavailability, the Seller is obliged to immediately notify the Buyer, and the Buyer has the right to terminate the contract and request a refund, or agree to a subsequent delivery deadline. The Seller will endeavor to deliver all ordered products in a single shipment. If this is not possible due to stock levels, the Seller reserves the right to deliver in multiple shipments and shall assume the delivery costs for subsequent shipments.
Delivery is performed in accordance with the terms of service of the courier company and is deemed completed at the moment the products are handed over to the courier service. In the event of a first unsuccessful delivery attempt, the courier service will leave a delivery notice including all the necessary contact details to arrange an alternative delivery date.
If a shipment addressed to the Buyer is returned to the Seller because the courier service failed to complete the delivery, the Buyer will be notified via email and offered the following options:
  • That the ordered shipment be re-delivered to the address of the Buyer or recipient upon the Buyer's email request, subject to additional delivery costs;
  • That the Buyer collects the ordered product at the Seller's address, upon a prior telephone or email agreement regarding the collection time.
When the Seller delivers the shipment to the Buyer via the courier service, the Buyer is obliged to take delivery by signing the delivery note, thereby confirming that the shipment has been properly delivered.
In the event that the Buyer orders goods and refuses to accept them, the Seller has the right to deduct the amount of delivery costs and other handling fees from the paid purchase price.
The following shall not be counted towards delivery deadlines:
  • The day of receipt of the order/request;
  • Delay time due to an incorrect or incomplete address provided by the Buyer;
  • Delay time due to force majeure or other reasons for which the Seller is not responsible;
  • Weekends, non-working days, and public holidays.
Unilateral Termination of the Contract
Only the Buyer who has placed an order, i.e., concluded a distance contract in accordance with these Terms of Use and Purchase, has the right to unilaterally terminate the contract within 14 days, without stating any reasons. The 14-day period begins from the day the shipment constituting the subject of the contract is delivered into the possession of the Buyer or a third party designated by the Buyer, other than the carrier/courier. If the Buyer ordered multiple products in a single order to be delivered separately, or if it involves multiple shipments, the period begins from the day the last shipment is delivered into possession.
Before the expiry of the deadline for unilateral termination, the Buyer is obliged to notify the Seller of their decision to terminate the contract at info@klaramaric.live. The Seller will acknowledge receipt of the notice of unilateral contract termination without delay via email.
If the Buyer unilaterally terminates the distance contract, the Seller will refund the money paid, excluding delivery costs. The costs of returning the shipment shall be borne by the Buyer. The Buyer is obliged to return the shipment immediately, and no later than 7 days from the day the decision on unilateral contract termination was sent. The shipment must be sent by mail in a verifiable manner to the address: Klara Marić d.o.o. owned by Klara Marić, Jurja Dobrile 2a, 52352, Kanfanar. The refund will be processed after the shipment is returned to the Seller, and no later than 7 days from the receipt of the returned shipment. The refund will be made using the same payment method used for the original transaction.
The Buyer is deemed to have fulfilled their obligation on time if they send the shipment to the Seller's address in a verifiable manner (registered mail with return receipt) before the expiry of the specified deadline. The Buyer is responsible for any reduction in the value of the goods resulting from the handling of the goods, other than that necessary to establish the nature, characteristics, and functionality of the product. If the product is returned defective, with significant damage, or without parts and documentation, and if it is not delivered within a subsequent period of 8 days, it is considered that the Buyer has not fulfilled their obligation to return the goods, and the Seller is not obliged to refund the funds paid.
The Buyer does not have the right to unilateral contract termination if:
  • The Seller has fully performed its service, provided that the performance began with the express prior consent of the Buyer, and with their confirmation of being aware of the fact that they will lose the right to unilateral contract termination once the service has been fully performed;
  • The subject of the contract is a product or service whose price depends on fluctuations in the financial market that are beyond the Seller's control, and which may occur during the period of the Buyer's right to unilateral contract termination;
  • The subject of the contract is a product made to the Buyer's specifications or clearly tailored to the Buyer;
  • The subject of the contract is a sealed product that is not suitable for return due to health protection or hygiene reasons, if it was unsealed after delivery;
  • The subject of the contract is a product which, by its nature, is after delivery inseparably mixed with other items.
Product Complaints (Claims)
Deadline for complaints: 7 days from the date of receipt of the order.
The Seller is liable for material defects of the products on the online store in accordance with the positive regulations of the Republic of Croatia, particularly the Civil Obligations Act.
The ordered products are packed in a manner that ensures they are not damaged during standard handling during transport/delivery.
Upon receipt of the shipment, the Buyer is obliged to check the delivered items and determine whether the shipment has been delivered in full, i.e., whether all products have been delivered. In the event of defects, the Buyer is obliged to submit a written objection/complaint immediately, as subsequent complaints will not be taken into consideration.
In the event that the shipment was damaged in transport, such damage is visible upon taking delivery of the shipment. In this case, the Buyer should refuse to accept the shipment and notify the Seller as soon as possible with a description of the problem. It is also recommended to take photographs of the damage.
In the event of a visible product defect upon taking delivery of the shipment, the Buyer is not obliged to accept the delivered product, may refuse receipt, and shall not bear the delivery costs of such product. Products that have been properly received by the Buyer shall be deemed to have had no visible defects. The Buyer has the right to file a complaint regarding material defects within the deadlines and for the reasons prescribed by the provisions of the Civil Obligations Act. The Buyer may submit a written objection or complaint via email to info@klaramaric.live or in writing to the address: Klara Marić d.o.o. owned by Klara Marić, Jurja Dobrile 2a, 52352, Kanfanar, marked "Complaint".
In order to identify the order subject to the Buyer's objection as quickly as possible, the Buyer is obliged to state the order number or invoice number in the objection.
The Buyer has the right to a justified objection and to the return of goods in the following cases:
  • Delivery of goods that were not ordered;
  • Delivery of goods that have a defect or damage that did not occur during transport.
The Seller will otherwise consider a complaint valid if, upon inspection of the product, it determines that it meets the conditions for a complaint in accordance with the Civil Obligations Act and the Consumer Protection Act. In this case, within 15 days from the receipt of a valid complaint, the Seller will replace the product or refund the full amount paid along with the termination of the contract. If, however, the Seller finds that the complaint is not valid, i.e., if it rejects the complaint, it will notify the Buyer of the same within 15 days from the date of receipt of the complaint.
The Seller will accept the return of damaged, defective, or incorrectly delivered goods at its own expense, provided that the objection is found to be justified and that the Buyer did not affect the correctness, damage, or any defect of the goods.
In the case of a justified complaint, the cost of replacement with a new product shall be fully borne by the Seller.
Personal Data Protection Policy
We wish to state clearly that when you visit this website, your personal data remains confidential unless you choose to disclose it voluntarily. We commit that, except for the purposes of a legal investigation, we will not disclose the data we receive to other parties. When you send us an electronic mail (email) containing personally identifiable information—either via an email message with a question or comment, or through a form submitted to us by email—we use that data for the purpose of fulfilling your requests. We may forward your email to other employees or suppliers who can better answer your questions. Personal data may be collected for the purpose of marketing activities. Further processing of personal data for historical, statistical, or scientific purposes shall not be considered incompatible, provided that appropriate protective measures are implemented.
